This End User License Agreement (“EULA” / “License”) is a legal agreement between you and Bomosi (“Licensor”) for the PassFirst software application for Apple iOS devices (the “Licensed Application”). The Licensed Application is licensed, not sold, to you.
This EULA is in addition to our Terms of Use and Privacy Policy. Apple is not a party to this License between you and Licensor, except as a third-party beneficiary as described by Apple where required. Your use of the App Store is also subject to Apple’s terms.

1. Scope of license
Licensor grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms (or successor terms). This License does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time, except as Apple’s Usage Rules expressly allow (for example Family Sharing / volume purchasing where applicable).
2. License restrictions
You may not (and may not permit others to):
- Copy the Licensed Application except as expressly allowed by this License or applicable law;
- Modify, translate, adapt, reverse engineer, decompile, disassemble, or create derivative works of the Licensed Application, except to the extent such restriction is prohibited by law;
- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application;
- Remove proprietary notices;
- Use the Licensed Application to provide a competing hosted service that redistributes its content wholesale; or
- Use the Licensed Application for any unlawful purpose.
3. Nature of the Licensed Application
PassFirst is a self-check / preparation utility. It is not an official inspection product. Official determinations are made by your PHA or authorized inspector. Passing is not guaranteed. The Licensed Application is not affiliated with HUD or any PHA. Bundled or displayed official reference text does not expand this License into a right to republish that material outside personal use with the App.
4. Consent to use of data
You agree that Licensor may process information as described in the Privacy Policy. Core inspection records and photos remain on your device and are not uploaded by the Licensed Application’s self-check workflow. Optional features (for example Settings → More Apps) may contact Licensor’s servers as disclosed in the Privacy Policy.
5. In-app purchases
Certain features may require in-app purchases processed by Apple. Payment, billing, refunds, and subscription management are handled by Apple under Apple’s terms. Consumable unlocks are device-local entitlements as described in the Terms of Use and are not guaranteed to be restorable after deletion of the App or App data.
6. Updates
Licensor may provide updates. Updates may modify or remove features. Continued use of an updated Licensed Application constitutes acceptance of the then-current EULA, Terms, and Privacy Policy presented with the App or on Licensor’s website.
7. External services
The Licensed Application may enable access to external services and websites (including Apple services, WhatsApp, Mail, or web pages). Use of third-party services is at your own risk and subject to those third parties’ terms. Licensor is not responsible for third-party content or availability.
8. No warranty
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE LICENSED APPLICATION WILL MEET YOUR REQUIREMENTS, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. NO SELF-CHECK RESULT CONSTITUTES AN OFFICIAL INSPECTION OUTCOME OR A GUARANTEE OF PASSING.
Some jurisdictions do not allow exclusion of implied warranties; in those jurisdictions, the above exclusions apply to the fullest extent permitted.
9. Limitation of liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, FAILED INSPECTIONS, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall Licensor’s total liability to you for all damages exceed the greater of fifty U.S. dollars (US$50) or the amount you paid for the Licensed Application features through Apple in the twelve (12) months preceding the claim. The foregoing limitations will apply even if any remedy fails of its essential purpose, to the extent permitted by law.
10. Export / compliance
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. By using the Licensed Application, you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Commercial items
The Licensed Application and related documentation are “Commercial Items” as defined under applicable U.S. regulation, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” licensed to end users only with the rights set forth herein.
12. Termination
This License is effective until terminated. Your rights under this License terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use and destroy all copies of the Licensed Application.
13. Governing law; third-party beneficiary
Except to the extent expressly provided in the following paragraph, this License and the relationship between you and Licensor shall be governed by the laws of India, excluding its conflicts of law provisions. This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
You and Licensor acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof, to the extent applicable under Apple’s requirements.
